Dear Mr. Shah, Nice of you to place vital information about FEMA. Please update information in whcih OCI (Overseas Citizen of India) card holders like me living in India would also be benefitted. If you can please answer my Q. I am an OCI living in India (for about 4 years as an PIO and for the last 4/5 years as an OCI) OCI entitles me to a lifelong Visa to India and all other benefits like NRI, barring a few. Every time I want to travel overseas, banks refuse to give me FOREX saying that I am a foreigner till I convince them that I am entitled to get up to US$10,000/- in any one year. I cannot go on convincing banks or travel agents on this.Is there something which I can show to these authorised agents/money changers so that I get the FOREX without argument? Thanks. Suresh

We are buying goods from mills , the unit is in remote area in maharashtra, the mill is exempted from VAT , when we resale the goods , do we need to charge the vat on full value or only the difference value ? please give the M VAT section also to explain to corporate customer.

I just like to know that in a pvt ltd company there are 6 directors out of which 5 directors had filled the din-3 and the other director has not filled the DIN -3 , can we file the form20 with this.

Dear Naresh, Can you please explain under what circumstances we can pay 5% tax on works contract with retention of 4% . Is it applicable in all cases of works contract or is there are a circular limiting the types of contracts

sir, i am preparing for ipcc may attempt and i have just started studying IHP.I was wanting to ask that,in case of deemed ownership,a member of a company is taken as a deemed owner.But what i think is the shareholders are the owners of the company (public).When we all know that shareholders are the owners then why are we considering them deemed owners.
Sir I have a quey can an independent Director sign the Balance Sheet of a company. please reply at my mail.

PRTNER'S DEATH IS A DEATH OF FIRM :
When there are two partners, and one of them dies, the firm is automatically dissolved even if there is clause in the partnership deed that the firm will continue in existence. In the case, Mohd Laiquiddin vs Kamala Devi one party claimed that the partnership continued though one partner had died. The court rejected this contention explaining that the firm is deemed to have been dissolved despite the existence of the clause. Upholding the view of the Andhra Pradesh high court, the SC saidpartnership is not a matter of heritable status; it is purely one of contract under Section 4 of the Contract Act.

Yse Mr. Makkad, absolutely true but its the case when there is only two partners. had there been two partners and the firm was not at will, the said firm would have continued even after the death of a partner.
Also, when a firm is at will then in spite of the fact that there are more than two partners in any firm, the firm gets dissolved even when a partner exits the firm or dies.
Correction to the earlier statement :
